EXCLUSIVE: Veoh has a warning for justices at the Ninth Circuit Court of Appeals who will consider overturning a lower court’s ruling in Universal Music Group’s big copyright infringement case.
“UMG’s interpretation of the law would, if applied, wreak havoc on a variety of new media portals like Yahoo!, Google and Facebook,” writes Veoh’s attorney Erin Ranahan in just-submitted written arguments.
Earlier this year, Veoh won a huge victory against UMG, which argued that Veoh should be held legally responsible for copyrighted material posted by users. A district court accepted Veoh’s arguments that the onus was on UMG to identify infringing material, and absent such notice, Veoh was protected from claims by the safe harbor provisions of the DMCA.
The triumph foreshadowed Google’s victory against claims by Viacom concerning copyright infringing material on YouTube. In fact, the judge in that case directly referenced the Veoh decision.
Viacom has promised an appeal, but before that happens, UMG gets its turn.

POPULAR dancehall Deejay Vybz Kartel, was last night released by the St Catherine South police.
Vybz Kartel, whose real name is Adijah Palmer, was one of 20 persons who Security Minister Dwight Nelson ordered released yesterday.
He handed himself in to the police four days after he was named as a person of interest.
Palmer spent one week in custody before the police sought and got permission to hold him for an additional 30 days. He has spent a total of two weeks behind bars.
His release will allow him to perform at next week’s Reggae Sumfest and other dates for which he was booked before he detention.
Among those who are also slated to be released are Sandra Coke, sister of former Tivoli Gardens strongman, Christopher ‘Dudus’ Coke.
Sandra Coke was warned to stay away from Tivoli Gardens and will be heavily monitored, police say.
She was taken in to the police by embattled clergyman Reverend Al Miller, who has since been charged with harbouring a fugitive and perverting the course of justice after he was held in the company of Christopher Coke at the time of his arrest last month.
Coke’s brother, Leighton ‘Livety’ Coke will not be released. He is among several persons named as area leaders who the police have detained. The others include Michaelous ‘Zeekie’ Phipps son of incarcerated Matthews Lane don, Donald ‘Zeeks’ Phipps; Klansman gang boss Tesha Miller; Justin O’Gilvie, a business partner of Christopher Coke and Cleveland ‘Cassie’ Downer.
They will remain detained under the Emergency Powers Act.

Lorenzen Wright missing since Sunday

Lorenzen Wright, a former Memphis Tiger and Memphis Grizzlies player, is missing.
The family of Wright says he’s been missing since Sunday.
Wright’s sister, Savia Archie, says her family is very concerned.
Archie said, Wright was last seen on sunday when he was expected to fly out of Memphis, but no one has heard from him since.
